Making A Claim
Are there any time limits for making a claim?
The rules state that you must start court proceedings with three years from when you were told about your asbestos related condition.
If you are outside of this three year time limit then the courts do have a discretion to still award you damages provided that you have acted promptly and certain criteria are met and that you have acted promptly.
Once you have been told that you are suffering from an asbestos related disease it is very important to contact us immediately before time runs out.
It is very easy to loose your rights, don't delay time is running and you must act sooner rather than later.
What if my employer has gone out of business?
It is important to note that this does not mean you cannot make a claim. The company can still be sued as we can resurrect them for the purpose of starting a court action.
As they probably went out of business many years ago it is highly unlikely that they will have any money to pay you your compensation.
Instead, the insurance company which provided insurance cover to the company during the time you worked for them are obliged to pay you your compensation.
We will do all we can to locate these insurers before resurrecting the company. There are many checks and enquiries we can make to locate the company or their former insurers which can often prove successful.
What if I did develop a further asbestos related condition in the future?
This is something you need to keep in mind during the course of your claim.
You can either accept a once and for all payment for your injuries. This means that you would not be able to return to court if you went on to develop any other asbestos related condition, or;
You can accept a much lower payment but with a right to return to court. This means that should you develop a further asbestos related condition you can ask for more compensation.
The decision on which kind of settlement you would like to obtain is one for you to make. We will discuss this in more detail with you and assist you in reaching an informed decision.
Will the Government compensate me?
There are benefits you may be eligible for from the Government. This is intended as a general guide, for more information we strongly recommend you contact your local welfare rights group or Citizens Advice Bureau for further information.
Industrial Injuries Disablement Benefit This is awarded to suffers of asbestos related conditions (except pleural plaques) provided that certain conditions are met. We will assist you in completing the application forms and guide you through the process.
Pneumoconiosis (Workers' Compensation) Act 1979 This is a one off payment to suffers of certain asbestos related conditions whose former employers have gone out of business. In order to qualify for this award you must have been awarded Industrial Injuries Disablement Benefit.
